Please read these Terms and Conditions carefully before usingwww.tutoringambitions.com.

These Terms and Conditions, together with our Privacy Policy, Cookie Policy and any other policies referred to within them, govern your access to and use ofwww.tutoringambitions.com("Our Site", "the Platform" or "Tutoring Ambitions").

By registering for an account, purchasing or booking a lesson, providing tutoring services or otherwise using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

1. About Tutoring Ambitions

Tutoring Ambitions is an online tutoring platform that enables learners, parents and guardians to find tutors, book and pay for lessons and access online educational services.

Tutors can create profiles, advertise their tutoring services, manage their availability and provide lessons through the Platform.

These Terms apply to learners, parents or guardians making bookings on behalf of learners, and tutors unless otherwise stated.

These Terms replace all previous versions.

2. Eligibility and Accounts

Users must provide accurate and complete information when creating an account.

Users must be at least 18 years old to create an account and independently enter into contracts through Tutoring Ambitions.

Where tutoring is provided to a learner under the age of 18, the account and booking must be created, authorised or supervised by a parent or legal guardian.

Parents and guardians are responsible for:

  • Providing accurate information about the learner.
  • Managing bookings and payments.
  • Ensuring appropriate supervision where necessary.
  • Ensuring the learner uses the Platform appropriately.
  • Reviewing tutor information and determining whether a tutor is suitable for the learner.

Users are responsible for maintaining the confidentiality of their login details.

Accounts must not be shared with unauthorised individuals.

Tutoring Ambitions should be notified immediately if a user believes their account has been compromised.

3. Tutoring Ambitions' Responsibilities

Tutoring Ambitions will take reasonable steps to:

  • Operate and maintain the Platform.
  • Enable tutors to advertise tutoring services.
  • Enable learners and parents to search for and book tutors.
  • Facilitate payments between learners and tutors.
  • Provide booking, messaging and online classroom functionality.
  • Review tutor applications before tutors are permitted to provide services through the Platform.
  • Review identification, qualifications and safeguarding documentation where applicable.
  • Notify users of bookings, cancellations and changes where the Platform supports such notifications.
  • Process eligible refunds.
  • Facilitate tutor payments.
  • Investigate complaints and disputes.
  • Take reasonable measures to protect users and the Platform from fraud, misuse and malicious software.
  • Maintain appropriate safeguarding procedures.

Tutoring Ambitions does not guarantee that the Platform will always operate without interruption or technical error.

4. Tutors Are Independent Professionals

Tutors provide tutoring services as independent, self-employed professionals.

Tutors are not employees, workers, agents or representatives of Tutoring Ambitions unless expressly agreed otherwise in writing.

Tutoring Ambitions facilitates the introduction, booking and payment process but does not employ tutors to provide tutoring services.

Tutors remain responsible for:

  • The tutoring services they provide.
  • Their own professional conduct.
  • Tax and National Insurance obligations.
  • Maintaining appropriate qualifications and experience.
  • Maintaining any required insurance.
  • Complying with applicable laws and safeguarding requirements.

Nothing in these Terms creates an employment relationship between Tutoring Ambitions and tutors.

5. Tutor Verification

Tutoring Ambitions may require tutors to provide documentation including:

  • Proof of identity.
  • Qualifications.
  • Employment or professional information.
  • References.
  • DBS or other safeguarding documentation.
  • Evidence of experience.

Tutoring Ambitions may refuse, suspend or remove a tutor where required documentation is missing, expired, inaccurate or considered insufficient.

Verification represents checks undertaken using the information available at the relevant time. It should not be interpreted as a guarantee of a tutor's future conduct or suitability for every learner.

6. Learner and Parent Responsibilities

Learners, parents and guardians agree to:

  • Provide accurate contact and learner information.
  • Provide valid payment information.
  • Attend booked lessons at the agreed time.
  • Treat tutors respectfully.
  • Use Platform communication appropriately.
  • Ensure suitable technology is available for online lessons.
  • Test their internet connection, microphone, camera and device where required.
  • Notify Tutoring Ambitions of safeguarding or conduct concerns promptly.

Tutoring Ambitions is not normally responsible for lessons disrupted by technical issues relating to the learner's own device, software, internet connection or environment.

7. Booking Lessons

Tutor availability is determined by individual tutors.

A lesson is only confirmed once the booking process has been completed and payment has been successfully received or authorised.

Tutoring Ambitions may provide:

  • Individual one-to-one lessons.
  • Trial lessons.
  • Block bookings.
  • Lesson packages.
  • Group classes.
  • Courses.
  • Educational resources.
  • Other educational services.

Prices, durations and relevant conditions will be displayed before purchase where applicable.

Tutor availability is not guaranteed until a booking has been confirmed.

8. Trial Lessons

Where a tutor offers a trial lesson, the duration and price of the trial will be displayed before booking.

Trial lessons are intended to allow a learner and tutor to determine whether they are suitable to continue working together.

A trial lesson does not:

  • Guarantee future tutor availability.
  • Guarantee that the learner will choose to continue with the tutor.
  • Guarantee any particular academic outcome.

Unless otherwise stated, the standard cancellation and rescheduling rules apply to trial lessons.

9. Lesson Cancellations

Scheduled lessons may be cancelled up to 24 hours before their scheduled start time.

Where a learner cancels at least 24 hours before the lesson, 100% of the applicable lesson fee will be refundable.

Where a learner cancels less than 24 hours before the scheduled start time, no refund will normally be provided.

Tutors reserve specific time for booked learners and may be unable to replace a booking at short notice.

Tutoring Ambitions may make reasonable exceptions in exceptional circumstances at its discretion.

10. Rescheduling

Lessons may normally be rescheduled up to 24 hours before their scheduled start time.

Requests made less than 24 hours before a lesson are not guaranteed.

Tutors are not required to accommodate a late rescheduling request.

If a tutor chooses to accommodate a late change, this will not create an entitlement to future exceptions.

11. Missed Lessons and Late Arrival

Where a learner does not attend a lesson and has not cancelled within the permitted cancellation period, the lesson will normally be treated as completed.

No refund will normally be provided.

If a learner arrives late, the tutor is not required to extend the lesson beyond its original scheduled finishing time.

For example, if a 60-minute lesson is booked from 4:00pm until 5:00pm and the learner joins at 4:20pm, the lesson may still end at 5:00pm.

Tutors should remain available for a reasonable period following the scheduled start time.

12. Tutor Cancellations and Tutor No-Shows

If a tutor cancels a confirmed lesson, the learner will ordinarily be offered one of the following:

  • A replacement lesson.
  • Rescheduling with the same tutor.
  • Credit towards another lesson.
  • A refund of the affected lesson.

If a tutor does not attend a confirmed lesson, the learner will not be charged for a service they did not receive.

Repeated tutor cancellations, lateness or non-attendance may result in review, restriction, suspension or removal from Tutoring Ambitions.

13. Block Bookings and Packages

Tutoring Ambitions may offer discounts where multiple lessons are purchased together.

Once an individual lesson from a block or package has been scheduled, the standard cancellation and rescheduling policy applies.

Unused lessons which have not yet been scheduled may be eligible for a refund.

Where a block-booking discount was applied and a learner requests a refund for part of the package, Tutoring Ambitions may recalculate lessons already taken at the tutor's standard price.

Any resulting difference may be deducted from the refund.

For example, a customer cannot necessarily use one discounted lesson and then retain the full discount while requesting a refund for the remainder of the package.

Any package-specific conditions displayed when purchasing will also apply.

14. Unscheduled Lessons

Where a purchased lesson has not been scheduled and no tutor time has been reserved for that lesson, the learner may normally request a 100% refund for the unused lesson.

This remains subject to:

  • Block-booking terms.
  • Promotional conditions.
  • Package discounts.
  • Services already partially used.
  • Any statutory rights or restrictions applying to the purchase.

15. Promotional Offers and Discount Codes

Tutoring Ambitions may provide discounts, promotional codes or special offers from time to time.

Promotional offers:

  • May have expiry dates.
  • May be limited to selected services or tutors.
  • May be limited to one use per person or household.
  • Cannot normally be exchanged for cash.
  • Cannot normally be combined unless expressly stated.
  • May be withdrawn or amended before purchase.

A promotional discount does not create an entitlement to the same price for future bookings.

Where a refund is issued for a discounted purchase, the refund will be calculated using the amount actually paid rather than the undiscounted price.

16. Payments

Payments must be made through Tutoring Ambitions unless otherwise expressly authorised.

Prices are displayed in GBP unless stated otherwise.

Users may pay using payment methods made available through the Platform.

Payment providers, banks and card issuers may impose:

  • Foreign transaction fees.
  • Currency conversion charges.
  • Card processing charges.

Tutoring Ambitions is not responsible for charges imposed independently by a user's bank or payment provider.

17. Chargebacks and Payment Disputes

Users should contact Tutoring Ambitions before initiating a payment dispute or chargeback where reasonably possible so that concerns can first be investigated.

Where a payment is reversed, disputed or subject to a chargeback, Tutoring Ambitions may temporarily suspend:

  • Account access.
  • Future bookings.
  • Tutor payments relating to the disputed transaction.

Tutoring Ambitions may provide relevant transaction, booking and service records to payment providers when responding to legitimate payment disputes.

Fraudulent chargebacks may result in account suspension or termination.

18. Circumventing the Platform

Learners and tutors must not use Tutoring Ambitions to establish contact and then deliberately arrange private tutoring outside the Platform for the purpose of avoiding Tutoring Ambitions' fees or commission.

Users must not:

  • Encourage another user to make payment privately.
  • Redirect bookings introduced through Tutoring Ambitions to another service.
  • Use contact information obtained through Tutoring Ambitions to deliberately bypass the Platform.

Tutoring Ambitions may suspend or terminate accounts where deliberate circumvention is identified.

19. Tutor Responsibilities

Tutors agree to:

  • Be at least 18 years old.
  • Provide truthful and accurate profile information.
  • Keep availability updated.
  • Attend confirmed lessons promptly.
  • Provide tutoring with reasonable care and skill.
  • Maintain a professional learning environment.
  • Maintain suitable technology and internet access.
  • Communicate professionally with learners and parents.
  • Follow applicable safeguarding requirements.
  • Protect confidential learner information.
  • Notify Tutoring Ambitions of material changes to information supplied during onboarding.
  • Not discriminate against, harass, intimidate or behave inappropriately towards learners.
  • Not complete examinations, coursework or assessed assignments on behalf of learners.

Tutors must not knowingly assist learners with academic misconduct.

20. Tutor Payments and Commission

Tutoring Ambitions charges tutors Platform commission in accordance with the applicable tutor agreement or fee structure.

Tutoring Ambitions may deduct:

  • Platform commission.
  • Agreed payment processing charges.
  • Refunds.
  • Chargebacks.
  • Other amounts legitimately owed under applicable agreements.

Tutor earnings may become available after a lesson has been completed or automatically marked as completed by the Platform.

Tutoring Ambitions may temporarily withhold payment where there is an active:

  • Refund request.
  • Payment dispute.
  • Chargeback.
  • Safeguarding investigation.
  • Complaint.
  • Fraud investigation.

21. Online Classroom and Lesson Recordings

Lessons may take place using third-party classroom technology integrated into Tutoring Ambitions.

Lessons may be recorded where recording functionality is enabled.

Recordings may be used for:

  • Safeguarding.
  • Quality assurance.
  • Investigating complaints.
  • Resolving disputes.
  • Reviewing reported misconduct.
  • Allowing authorised users to review learning content where this service is available.

Users must not independently publish, distribute or commercially exploit recordings containing another person's image, voice or personal information without appropriate permission.

Processing of personal information is governed by the Tutoring Ambitions Privacy Policy.

22. Safeguarding

Tutoring Ambitions takes the safety and welfare of children and vulnerable individuals seriously.

Users should report safeguarding concerns as soon as reasonably possible.

Tutoring Ambitions may temporarily restrict accounts, communications or bookings while investigating safeguarding concerns.

Where required or reasonably necessary to protect an individual, information may be shared with:

  • Police.
  • Local authorities.
  • Safeguarding organisations.
  • Regulatory bodies.
  • Other legally authorised organisations.

Where a learner is under 18, parents and guardians remain responsible for determining an appropriate level of supervision during online tutoring.

23. Conduct and Communication

Users must communicate respectfully.

Tutoring Ambitions does not tolerate:

  • Bullying.
  • Harassment.
  • Threatening behaviour.
  • Sexual or inappropriate communication.
  • Discriminatory behaviour.
  • Hate speech.
  • Fraud.
  • Attempts to exploit children or vulnerable people.

Serious misconduct may result in immediate account suspension or termination.

24. Educational Outcomes

Tutoring can support a learner's education but results depend upon many factors outside the tutor's or Tutoring Ambitions' control.

Tutoring Ambitions and tutors do not guarantee:

  • Examination results.
  • Particular grades.
  • School admission.
  • University admission.
  • Scholarship awards.
  • Academic improvement within a particular timeframe.

References to previous learner outcomes or tutor success rates should not be interpreted as guarantees of future performance.

25. Educational Resources and Intellectual Property

Content produced by Tutoring Ambitions, including branding, website content, graphics, course materials and other original materials, is owned by or licensed to Tutoring Ambitions Ltd unless stated otherwise.

Users must not reproduce, redistribute, sell or commercially exploit Tutoring Ambitions materials without permission.

Tutors generally retain ownership of teaching resources they independently create unless a separate agreement provides otherwise.

Learners purchasing educational resources receive a personal, non-transferable right to use those resources unless otherwise stated.

Resources must not be:

  • Resold.
  • Uploaded publicly.
  • Shared commercially.
  • Reproduced for distribution.

26. Third-Party Services

Tutoring Ambitions may integrate third-party services including payment providers, video classroom providers and other technology providers.

Tutoring Ambitions is not responsible for temporary interruptions caused exclusively by third-party systems outside its reasonable control.

Different third-party services may also be subject to their own terms and privacy policies.

27. Circumstances Outside Our Control

Tutoring Ambitions will not be responsible for failure or delay caused by circumstances reasonably outside its control.

These may include:

  • Internet outages.
  • Power failures.
  • Major technology failures.
  • Cyber incidents.
  • Severe weather.
  • Natural disasters.
  • Government action.
  • Industrial disputes.
  • Failure of third-party infrastructure.

Where possible, Tutoring Ambitions will take reasonable steps to minimise disruption.

28. Complaints

Complaints should be submitted toadmin@tutoringambitions.com.

Users should provide sufficient information for the matter to be investigated, including where relevant:

  • Booking information.
  • Tutor or learner name.
  • Date of lesson.
  • Description of the issue.
  • Supporting evidence.

Tutoring Ambitions may review relevant booking information, communications, payment records and lesson recordings when investigating a complaint.

29. Refund Processing

Approved refunds will ordinarily be issued to the original payment method.

Processing time is dependent upon the relevant bank or payment provider and may therefore take several working days after Tutoring Ambitions has issued the refund.

Tutoring Ambitions cannot guarantee when an individual bank will display the refunded funds.

30. Suspension and Termination

Tutoring Ambitions may suspend, restrict or terminate an account where a user:

  • Breaches these Terms.
  • Provides materially false information.
  • Commits or attempts fraud.
  • Misuses payment systems.
  • Circumvents Platform payments.
  • Behaves abusively.
  • Creates a safeguarding concern.
  • Repeatedly fails to honour bookings.
  • Misuses the Platform.

Serious safeguarding or fraud concerns may result in immediate suspension while an investigation is conducted.

Users may stop using Tutoring Ambitions at any time, but existing financial or contractual obligations will continue where applicable.

31. Our Right to Make Changes

Tutoring Ambitions may update these Terms where necessary, including to reflect:

  • Changes to our services.
  • Changes to technology.
  • Changes to payment arrangements.
  • Changes in law or regulation.
  • Changes to Platform functionality.

The most current version will be published on the website.

Where a change materially affects registered users, Tutoring Ambitions will take reasonable steps to provide notice.

32. Liability

Nothing in these Terms excludes liability where exclusion would be unlawful, including liability for:

  • Death or personal injury caused by negligence.
  • Fraud.
  • Fraudulent misrepresentation.
  • Rights that cannot legally be excluded under UK consumer law.

Tutoring Ambitions is not responsible for indirect losses that could not reasonably have been anticipated when the relevant contract was entered into.

Nothing within these Terms affects a consumer's statutory rights.

33. Consumer Rights

These Terms do not remove or limit rights granted to consumers by applicable UK consumer law.

Where legislation gives a consumer a right to cancel, receive a refund or obtain another remedy, those statutory rights take priority over any conflicting provision of these Terms.

Where a consumer requests that a service begins during any applicable statutory cancellation period, their cancellation rights may be affected once the service has begun or been fully performed, where permitted by law.

34. Severability

Each section of these Terms operates separately.

If a court or relevant authority determines that any provision is unlawful or unenforceable, the remaining provisions will continue in force.

35. No Waiver

If Tutoring Ambitions does not immediately enforce a provision of these Terms, this does not mean that Tutoring Ambitions has waived the right to enforce it later.

36. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the courts of England and Wales, subject to any mandatory rights consumers have to bring proceedings elsewhere.
